Deceptive Chocolate

A chocolate controversy appears to be headed to the court system, as a woman from Florida sued the famous chocolate company, Hershey, for 5 million dollars over “misleading” Reese’s Peanut Butter Cup wrapper designs. She was distraught to find her Reese’s pumpkins, which she bought in October, did not have a Jack-O-Lantern face on them like how they were advertised on  orange wrappers.

The lawsuit is not only about the grievances of one person. Several people who have bought the chocolate products claim that they have been lied to by Reese’s. This lawsuit includes Reese’s white pumpkins, ghosts, and others. The lawsuit has pictures of proof that the chocolate inside the packaging does not match the wrapper, stating that Hershey has changed the look of their Reese’s packaging in the past two or three years to boost sales of the specific product.

The lawsuit was filed in federal court in Florida on December 28, 2023, and cites the Florida Deceptive and Unfair Trades Act (FDUTPA) in it. The plaintiff alleges what Hershey is doing is immoral and unethical to customers. She and the subsequent class do not just want a jury trial, but also want Hershey to financially cover for their misrepresentations,  award them compensation, and correct the deceptive behavior. The judge sided with her and many other people to successfully make the claim that the advertising could trick a customer.
